Introduction

These Terms of Use ("Terms") constitute a legal agreement between you ("you" or "User") and Pavel Klimchyk ("I", "me", or "my"), governing your use of my mobile application (the "App"). By using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

I may update these Terms at any time. The latest version will always be available within this page. Please check the "Effective as of" date at the top of this page to see when these Terms were last updated. By continuing to use the App after any changes, you agree to the updated Terms.

Eligibility

You must be at least 16 years old to use the App if you are a resident of the European Union, or at least 13 years old in other jurisdictions where applicable. By using the App, you represent and warrant that you meet the applicable age requirement and have the legal capacity to enter into these Terms.

If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

No Affiliation with TikTok

This App is an independent tool and is not affiliated with, endorsed by, or sponsored by TikTok or its parent company ByteDance Ltd. All TikTok trademarks, logos, and brand elements belong to their respective owners. Any use of TikTok- related data or public information within the App complies with TikTok's official terms of use and API guidelines.

Account Connection and Security

When you connect your TikTok account or otherwise interact with the App, you are responsible for maintaining the confidentiality and security of your device and login credentials. You agree to notify me immediately of any unauthorized use or security breach.

User Conduct

You agree to use the App in a lawful manner and not to:

• Violate any applicable law or regulation
• Interfere with or disrupt the operation of the App
• Use the App for any fraudulent or harmful purpose
• Attempt to gain unauthorized access to any portion of the App

User-Generated Content and Safety

The app does not allow users to create, upload, publish, or manage any content. All videos displayed in the app are provided directly by TikTok and remain fully hosted, generated, and moderated by TikTok. The app only displays this third-party media and does not offer any functionality for posting, commenting, or contributing user-generated content.

If you encounter content that you believe is inappropriate or violates applicable guidelines, you may contact me through the in-app support option or by email at dev.go.viral@gmail.com. Within 24 hours, I will review the report and, if the content is objectively inappropriate, I will remove the specific item from the app's feed. This action affects only the content displayed within this app and does not remove or alter the original content on TikTok, which remains subject to TikTok's moderation and community rules.

TikTok's own moderation systems are responsible for filtering, reviewing, and enforcing all rules related to the videos hosted on their platform.

Subscriptions and In-App Purchases

Some features of the App are available only through paid subscriptions or one- time in-app purchases. Payment for such services is processed securely through Apple's App Store and subject to Apple's applicable terms and conditions.

When you purchase a subscription, your Apple ID account will be charged upon confirmation of purchase. Subscriptions automatically renew unless you turn off auto-renewal at least 24 hours before the end of the current period. Renewal charges will be applied to your Apple ID account within 24 hours before the current subscription expires.

You can manage or cancel your subscriptions at any time by going to your Apple ID account settings on your device. I do not process or have access to your payment information.

If you uninstall the App without cancelling your subscription, the subscription will remain active until cancelled through your Apple ID account.

No refunds are provided for unused portions of a subscription period, except as required by applicable law or Apple's refund policy.

Intellectual Property Rights

All content, features, and functionality of the App (excluding public TikTok profile data) are the property of Pavel Klimchyk and are protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, or exploit any part of the App without prior written permission, except for specific content made available for personal use, such as hashtag suggestions or analytics summaries, which you may copy and use for your own content creation.

Privacy

My handling of personal data is governed by my Privacy Policy. By using the App, you agree to the collection and use of information as described in that policy.

Third-Party Services

The App may include links or integrations with third-party services, such as analytics or payment platforms. These services are governed by their own terms and privacy policies. Termination

I reserve the right to suspend or terminate your access to the App at any time and for any reason, including if you violate these Terms. Upon termination, your right to use the App will immediately cease.

Disclaimers and Limitation of Liability

The App is provided "as is" and "as available" without warranties of any kind. I do not guarantee that the App will be error-free, uninterrupted, or secure.

To the fullest extent permitted by law, I disclaim all liability for damages arising out of or in connection with your use of the App. This includes, but is not limited to, direct, indirect, incidental, or consequential damages.

Technical Requirements and Network Usage

Some functions of the App require an active internet connection, which can be provided via Wi-Fi or a mobile data network. I am not responsible if the App does not function properly due to lack of internet access or network restrictions.

If you use the App outside of a Wi-Fi area, please be aware that your mobile network provider's terms and charges may apply, including data or roaming fees. By using the App, you accept responsibility for any such costs.

It is your responsibility to ensure that your device is charged and functioning properly. I am not responsible if you cannot use the App due to a discharged battery or hardware malfunction.

Although I strive to keep the App updated and functioning correctly, I do not guarantee that it will be free of errors or available at all times. You are responsible for ensuring compatibility with your device.

I accept no liability for any loss, direct or indirect, that you may experience as a result of using or being unable to use the App.

Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Poland, where I operate the App, without regard to conflict of law principles. Any disputes shall be resolved in the competent courts of Poland.
